What you should know before withdrawing a trademark
Pending Applications Only
Withdrawal applies to applications not yet registered โ a registered mark must be surrendered separately.
TM-M is the Form
A miscellaneous trademark application (TM-M) is the prescribed form for withdrawal.
Filing Fee Not Refunded
The original application filing fee is not refunded on withdrawal.
Priority Date is Lost
Withdrawing the application means losing the priority date โ relevant if re-filing a modified mark.
Partial Withdrawal Possible
You can narrow the specification of goods/services instead of withdrawing the whole application.
Registered Mark โ Surrender
A registered trademark can be surrendered (not withdrawn) under Section 57 of the Trade Marks Act, 1999.
Withdrawal is irreversible. Once the application is withdrawn, the filing date and priority are lost. Before filing withdrawal, we always assess whether a narrowed specification, a modified mark or a negotiated coexistence agreement is a better outcome.
