Trademark renewal rules in India
10-Year Validity
Registration valid for 10 years from the date of application โ not from the date of registration.
Renewal Window
TM-R can be filed up to 6 months before the expiry date.
Grace Period โ 6 Months
If missed, renewal can still be filed within 6 months after expiry with a surcharge.
Restoration โ 1 Year
If the grace period is also missed, restoration application can be filed within 1 year of lapse.
After 1 Year โ Mark Lapses
A mark not renewed within 1 year of expiry is removed from the register and can be re-applied for by anyone.
Renewal is Class-Specific
If the mark is registered in multiple classes, renewal covers all classes under one TM-R.
A lapsed trademark can be re-filed by a competitor. Once removed from the register, the mark is no longer protected and a third party can apply for it. Renewal on time is the only way to maintain your rights indefinitely.
